1. Acceptance of Terms

By accessing or using the MyBillables application (the "Service"), provided by Geminiblue Consultancy ("Company"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

MyBillables is a billable hour tracking system that helps users manage clients, case files, and billable hours. The Service is provided on an "as is" and "as available" basis.

3. User Responsibilities

• You are responsible for maintaining the confidentiality of your account and password.
• You are responsible for all activities that occur under your account.
• You agree not to use the Service for any illegal or unauthorized purpose.
• You are solely responsible for the accuracy, quality, and legality of the data you upload, including your client and case file information.

4. Intellectual Property

All right, title, and interest in and to the Service (excluding data provided by you) are and will remain the exclusive property of Geminiblue Consultancy. The look and feel of the Service is copyright © Geminiblue Consultancy. All rights reserved.

5. Data Ownership

You retain all ownership rights to the data you upload to the Service. We will not access, view, or use your data except as necessary to maintain or provide the Service, or as required by law.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Geminiblue Consultancy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

7. Billing

Billing for the Service, which includes various offerings such as standard subscriptions, 3-month licenses, 6-month licenses, and customized enterprise plans, is managed by Geminiblue Consultancy through the PayFast Payment gateway. All payments are processed in South African Rand (ZAR). Standard subscriptions are provided for a fixed 12-month period. At the end of this 12-month cycle, your subscription will not automatically renew; you will need to initiate a new subscription or extend your existing plan. By subscribing to our Service, you agree to these billing terms. Geminiblue Consultancy reserves the right to change pricing upon reasonable notice. If Geminiblue Consultancy cancels or terminates your service, no refund will be provided. While we strive for satisfaction, all other refunds are subject to our sole discretion. 8. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, no refunds will be provided for any unused portion of your subscription or license.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.
